The controlling question on this appeal is whether or not such an agency relationship existed between appellant and one Shipp, the driver of the automobile involved, that the former was liable for the laters negligence under the doctrine of respondeat superior. Appellant moved to quash the service of summons on the alleged agent, but we will assume this defendant was properly before the court. The determinative issue is whether or not appellant was entitled to a directed verdict.
